By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein.

SECTION 1 - PRODUCT CLASSIFICATION & PERMITTED USAGE

1.1 Food Supplement Status: Products sold by MUUNSHOTS GmbH are classified as food supplements in accordance with EU Directive 2002/46/EC and Austrian national legislation. They are intended to supplement the diet and are not medicinal products.

1.2 Authorized Health Claims: In accordance with EU Regulation (EU) No 432/2012, the following authorized claims apply to our melatonin products:

• Sleep Onset: Melatonin contributes to the reduction of time taken to fall asleep. 

• Jet Lag: Melatonin contributes to the alleviation of subjective feelings of jet lag. 

1.3 Safety Warnings: Food supplements should not be used as a substitute for a varied and balanced diet and a healthy lifestyle. Do not exceed the recommended daily dose of 1mg. Keep out of reach of young children. Consult a physician before use if you are pregnant, breastfeeding, or taking medication.

SECTION 2 - RIGHT OF WITHDRAWAL & RETURNS

2.1 Statutory Right: Consumers within the European Union have the right to withdraw from this contract within 14 days without giving any reason.

2.2 Hygiene Exception: Pursuant to Article 16(e) of Directive 2011/83/EU, the right of withdrawal is excluded for sealed goods which are not suitable for return due to health protection or hygiene reasons if they become unsealed after delivery. Once the safety seal of a supplement bottle is broken or tampered with, the product is no longer eligible for return or refund.

SECTION 3 - SHIPPING & DELIVERY

3.1 Logistics: All orders are fulfilled by our partner, LOGSTA GmbH (Quivo Österreich), and shipped from Austria.

3.2 Risk of Loss: For consumers, the risk of loss or damage to the goods passes to you only when you or a third party indicated by you has acquired physical possession of the goods.

SECTION 4 - PRICING & PAYMENTS

All prices are listed in EUR and include the applicable statutory Value Added Tax (VAT) for Austria. Shipping costs are charged separately and are clearly displayed during the checkout process.

SECTION 6 - GOVERNING LAW & JURISDICTION

6.1 Governing Law: These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of Austria, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

6.2 Venue: For all disputes arising from this contract, the competent court in Vienna, Austria shall have exclusive jurisdiction.

6.3 Dispute Resolution: The European Commission provides a platform for Online Dispute Resolution (ODR), which can be accessed at: https://ec.europa.eu/consumers/odr.
